GENERAL CONDITIONS AND INSTRUCTIONS FOR BUSINESS WITH COMPANY GOLTE D.O.O. – HOTEL GOLTE

1. GENERAL PROVISIONS
General provisions are the component part of the contract / reservation or voucher, which is concluded between GOLTE d.o.o. and the passenger, who is applying for a certain tourist arrangement. If an individual programme specifies any article of the general conditions and instructions of business differently, the specification stated in the programme takes effect.

2. APPLICATION
The application is possible at the administration of GOLTE d.o.o., Radegunda 19c, Mozirje, and at the authorized agencies. Upon application, GOLTE d.o.o. and the passenger conclude a contract/reservation, which at the same time serves as a certificate of reservation and includes the information about the passenger's tourist arrangement or contains a reference to the arrangement programme stating this information. Upon application, the passenger is obliged to state all the information and submit the necessary documents required by the programme, and settle the prepayment. If upon application the passenger does not state true information, he or she is accountable for all possible costs or consequences which may arise due to false data.

3. PRICES
Prices of the arrangements are specified in the programmes and are valid from the day of publication. GOLTE d.o.o. reserves the right to change the prices in accordance with the Obligations Act. GOLTE d.o.o. notifies the passenger in case of price change. All prices include Value added tax.

4. PAYMENT
Upon application the passenger settles the prepayment of 30% of the entire arrangement price or as it is stated in the programme. The remaining part is settled upon the delivery of travelling document or voucher but no later than 8 days prior to the beginning of the trip or as stated in the programme. If the passenger does not pay the remaining part of the arrangement within the agreed time it is understood that he or she cancelled the arrangement and GOLTE d.o.o. acts according to the provisions about the cancellation of the arrangement from Article 6 of the General conditions and instructions for tourist arrangements.

5. CANCELLATION OR CHANGE OF TRIP BY THE PASSENGER
The passenger has the right to written or verbal cancellation of the trip. In such case, GOLTE d.o.o. has the right to the recovery of costs connected to the cancellation. In respect to the time of cancellation the costs are:
- up to 30 days prior to the departure: administrative costs of 10.00 EUR;
- from 29 to 22 days prior to departure: 20% of arrangement costs;
- from 21 to 15 days prior to departure: 30% of arrangement costs;
- from 14 to 8 days prior to departure: 50% of arrangement costs;
- from 7 to 1 day prior to departure: 80% of arrangement costs;
- on the day of departure or after the departure: the entire arrangement costs.
During the trip the passenger can abort the trip solely on his or her specific request and with a written statement of termination. In case the passenger aborts the trip and does not notify the agency about the termination, he or she is not eligible for cost refund upon return.

6. CANCELLATION RISK
Regardless the paid cancellation fee GOLTE d.o.o. has, in case of passenger's cancellation, the right to administrative cost reimbursement in the amount of 10.00 EUR per voucher.

7. CANCELLATION OR CHANGE OF TRIP BY GOLTE D.O.O.
GOLTE d.o.o. in accordance with existing laws reserves the right to cancel the trip no later than 5 (five) days prior to departure if there are not enough passengers applied for the trip. The smallest amount of passengers is stated in the individual programme. GOLTE d.o.o. cannot be held responsible for the changes occurring as a result of natural disasters or other occurrences not under GOLTE d.o.o.'s influence, the same goes for any changes due to force majeure during the trip. In these cases, GOLTE d.o.o. can ensure services in the changed form according to the existing possibilities. If the situation in the place of residence does not enable GOLTE d.o.o. to accommodate the passengers in the afore chosen facility, GOLTE d.o.o. can accommodate the passenger in the same place but other facility of at least the same category.

8. INFORMATION
Information given to the passenger at the location of application does not bind GOLTE d.o.o. more than statements in the offer or in the trip programme.

9. COMPLAINTS
If the services described in the programme lack quality or are not completely carried out, the passenger may require proportional compensation on the basis of a written complaint. The passenger is required to make a complaint about the inappropriate service on the location with the service provider. If the cause of the complaint cannot be remedied on the location, the passenger is requested to file a written complaint no later than 8 days after the return at the location of application. At the same time, any receipts of additional costs must be provided. The organiser is required to issue a written decision about the complaint within 30 days of the reception of the complaint. Until the organizer issues a decision, the passenger waives the right to mediation of any third persons, judicial establishments or any statements to the media. The maximum compensation after the complaint can reach the amount of the arrangement price. This excludes the buyer's right to compensation of ideal damages.

10. FINAL PROVISIONS
If any disputes occur among the parties, the court in Velenje has authority.
